A significant number of people toward the end of their lives suffer to a greater or lesser extent a reduction in their mental and physical capacity at which time their ability to manage their affairs can become impaired. In the event of a loss of mental capacity an individual is unable to make decisions and it is necessary to approach the courts to obtain an order appointing a deputy. These proceedings are usually time consuming and expensive.

An alternative is to make a Lasting Power of Attorney before the onset of disability and dementia whereby advance provision is made for this scenario in accordance with the wishes of the individual. This results in a significant saving of time and expense and makes the continuing care of an elderly person very much easier for family members. The preparation of the forms for a Lasting Power of Attorney is potentially complicated and subject to rigid procedures. Barton & Co is well placed to undertake this task.
